AIR-eSIM for global service terms of use

These terms of use (hereinafter referred to as "these Terms of Use") set out the terms of use for AIR-eSIM for global (hereinafter referred to as "the Service") provided on this website by AIR-U Inc. (hereinafter referred to as "our company"). Registered users (hereinafter referred to as "Users") must use the Service in accordance with these Terms of Use.

Article 1 (Application)

1. These Terms of Use shall apply to all relationships between the User and the Company regarding the use of the Service.

2. In addition to these Terms of Use, the Company may make various provisions regarding the Service, such as rules for use (hereinafter referred to as "Individual Provisions"). Regardless of their name, these Individual Provisions shall constitute part of these Terms of Use.

3. In the event of a conflict between the provisions of these Terms of Use and the provisions of the Individual Provisions, the Individual Provisions shall take precedence, except where otherwise provided in the Individual Provisions.

Article 2 (User Registration)

1. For the Service, the User must agree to these Terms of Use, apply for user registration in the manner specified by the Company, and the User registration will be completed when the Company notifies the User of its approval.

2. If the Company determines that an applicant has any of the following reasons, the Company may not approve the application for user registration, and the Company shall not be obligated to disclose the reasons therefor.

2. If the application is from someone who has previously violated these Terms of Use

3. Any other reason that the Company determines that registration is inappropriate.

Article 3 (Management of User ID and Password)

1. Users shall manage their user IDs and passwords for this service at their own responsibility.

2. Under no circumstances may a user transfer or lend their user ID or password to a third party, or share it with a third party. If a user logs in using a user ID and password combination that matches the registered information, the Company will consider that the user ID is being used by the user who registered it.

3. The Company shall not be liable for any damages arising from the use of the user ID and password by a third party, except in cases where the Company is guilty of willful misconduct or gross negligence.

Article 4 (Sales Contract)

1. In this service, a sales contract is established when a user makes a purchase application to our company and our company notifies the user that the application has been accepted. The ownership of the product will be transferred to the user at the time of notification by email or other means.

2. If the User falls under any of the following circumstances, the Company may cancel the sales contract set forth in the preceding paragraph without prior notice to the User.

2. Any other case where it is deemed that the relationship of trust between the Company and the User has been damaged.

3. The usage fees and payment methods for this service, how to cancel a purchase application, or how to return products, etc. will be determined separately by our company.

Article 5 (Intellectual Property Rights)

The copyright and other intellectual property rights of the product photos and other content (hereinafter referred to as "Content") provided by this Service belong to the legitimate rights holders, such as our company and content providers, and users may not copy, reproduce, modify, or make any other secondary use of such Content without permission.

Article 6 (Prohibited matters)

When using this service, users must not engage in the following acts.

1. Any act that violates laws, regulations or public order and morals

2. Any act related to criminal activity

3. Any act of infringing copyright, trademark or other intellectual property rights contained in the Service.

4. Any act that destroys or interferes with the functioning of our servers or networks

5. Commercially using information obtained through the Service

6. Any act that may interfere with the operation of our services.

7. Any act of unauthorized access or attempting such access

8. Collecting or storing personal information about other users

9. Impersonating other users

10. Any act of directly or indirectly providing benefits to anti-social forces in relation to our services.

11. Any other conduct that the Company deems inappropriate

Article 7 (Suspension of provision of the Service, etc.)

1. If the Company determines that any of the following events occur, the Company may suspend or interrupt the provision of all or part of the Service without prior notice to the User.

1. When performing maintenance, inspection, or updates on the computer system related to this service

2. When it becomes difficult to provide the Service due to force majeure such as earthquake, lightning, fire, power outage or natural disaster.

3. When a computer or communication line is stopped due to an accident.

4. Any other reason that the Company determines that it is difficult to provide the Service.

2. The Company shall not be liable for any disadvantage or damage suffered by the User or a third party due to the suspension or interruption of the provision of the Service, regardless of the reason.

Article 8 (Restrictions on Use and Cancellation of Registration)

1. If any of the following applies, the Company may restrict the User's use of all or part of the Service or cancel the User's registration without prior notice.

1. If you violate any provision of these Terms of Use

2. If it is discovered that any of the registered information is false.

3. If the credit card registered by the user as a payment method is suspended.

4. If there is a default in payment obligations such as fees.

5. If there is no response to our contact for a certain period of time

6. If the Service has not been used for a certain period of time since the last use

7. Any other reason that the Company determines that use of the Service is inappropriate.

2. The Company shall not be liable for any damages incurred by the User as a result of any actions taken by the Company pursuant to this Article.

Article 9 (Withdrawal)

Users may cancel their membership of this service by following the designated cancellation procedure.

Article 10 (Disclaimer of Warranties and Disclaimers)

1. The Company does not guarantee that the Service is free from factual or legal defects (including defects regarding safety, reliability, accuracy, completeness, validity, suitability for a particular purpose, security, etc., errors and bugs, infringement of rights, etc.).

2. The Company shall not be liable for any damages incurred by the User as a result of the Service. However, if the contract between the Company and the User regarding the Service (including these Terms of Use) is a consumer contract as defined in the Consumer Contract Act, this disclaimer shall not apply. However, even in this case, the Company shall not be liable for any damages incurred by the User due to breach of contract or tort caused by the Company's negligence (excluding gross negligence), including damages arising from special circumstances (including cases where the Company or the User foresaw or could have foreseen the occurrence of the damages).

3. The Company shall not be liable for any transactions, communications, or disputes that arise between users and other users or third parties regarding the Service.

 

Article 11 (Changes to Service Content, etc.)

The Company may change the content of the Service or discontinue the provision of the Service without notifying the User, and shall not be liable for any damages incurred by the User as a result thereof.

Article 12 (Changes to Terms of Use)

If the Company deems it necessary, the Company may change these Terms of Use at any time without notifying the User. If the User begins using the Service after the Terms of Use have been changed, the User will be deemed to have agreed to the changed terms.

Article 13 (Handling of Personal Information)

We will handle personal information obtained through the use of this service appropriately in accordance with our "Privacy Policy."

Article 14 (Notification or Contact)

Any notice or communication between the user and our company will be made in the manner specified by our company. Unless the user notifies us of a change in accordance with a method separately specified by our company, our company will consider the currently registered contact information to be valid and will notify or contact the user at that contact information, and such notice or communication will be deemed to have reached the user at the time of sending.

Article 15 (Prohibition of Transfer of Rights and Obligations)

Users may not transfer or pledge their status under the Service Agreement or their rights or obligations under these Terms of Use to a third party without our prior written consent.

Article 16 (Governing Law and Jurisdiction)

1. These Terms of Use shall be governed by the laws of Japan. The application of the United Nations Convention on Contracts for the International Sale of Goods to this Service shall be excluded.

2. In the event of a dispute regarding the Service, the court with jurisdiction over the location of our head office shall be the court of exclusive jurisdiction.
